Our Services
Estate Planning
Everyone, regardless of wealth or status, has an estate. Your estate encompasses assets and possessions that you call your own and that will need to go somewhere when you die. We can help you with planning, administration and probate, and special family issues. Establishing a plan is perhaps one of the most basic – and under-exercised – inviolable rights you possess.
Estate Administration
Estate administration is the process by which a decedent’s assets are distributed after the satisfaction of certain legal requirements. This process is also commonly known as “probate.” Probate is necessary when an asset previously owned by a person who has died otherwise has no new ownership automatically designated.
Estate Proceedings
The Estate Proceedings practice at Burt Schain Law Group includes proceedings and limited litigation relating to probate. April Burt Schain has extensive experience in all types of estate administration and will ensure you receive complete advice and effective representation.
Burt Schain’s Team
Asheville-based attorney April Burt Schain focuses her practice in the areas of estate planning, probate, and estate proceedings.
When you contact Burt Schain Law Group, you can expect to be treated with respect and consideration. You will receive a prompt return phone call and clear communication about your initial appointment. When you retain us, we will explain our billing process clearly, so that you understand where your money is going. April is supported by a team of four experienced legal assistants.
We offer an initial no-cost consultation in estate planning matters (wills, trusts, POAs, etc.). April will recommend an estate planning package tailored to your needs, and will give you a clear timeline within which to expect your documents. Should you decide to go forward, you will pay a flat fee, which includes the drafting of the documents, ample reviews and discussions as needed, and facilitation of the proper execution of the documents as required by law.
People who have recently lost a loved one are already wrestling with grief and other strong emotions — and find themselves also having to manage the responsibility of another’s estate. In your first consultation, for which we will charge a reasonable fee, we will answer all your questions and will clearly explain the probate process, with all its required reporting and deadlines, so that you can prioritize what is necessary and allow for you and your family’s self-care.
